Wyo. Senate concurs with House on eminent domain

CHEYENNE, Wyo. — The Wyoming Senate is agreeing with the House over a bill that would require energy companies and others using the power of eminent domain to condemn private property to pay a landowner's legal fees if the courts find they didn't offer a fair price for the land.

The Senate on Tuesday had voted not to agree with House amendments. But on Wednesday, with time running short in the Legislative session, the Senate reconsidered and voted to agree with the House.

The bill that now heads to Gov. Matt Mead would require the entity seeking to condemn land to pay the landowner's legal fees and other costs if a judge determined that the fair market value of the land was at least 15 percent higher than the entity's final offer.
